Respond to TM Objection

Trademark Examiners examine trademark applications after they have been filed and search for earlier marks that are identical or similar to the mark being examined. The trademark examiner's findings are summed up in the trademark examination report. Once an objection is filed the applicant will be given due notice about the objection as well as the grounds of objection. The first thing one must do is file a counter statement to the objection. Failure to file an objection within 2 months will change the status of the application to Abandoned. A trademark objection occurs when a trademark examiner, public or a third party objects to the registration of a particular trademark. The Government trademark examiner can object to a trademark registration application by seeking valid explanations about the mark.
